QGM reserves the right to reject any WWW site content that, in the sole opinion of QGM, is illegal, racist, pornographic, or otherwise offensive, or in direct competition with services provided by QGM. If client provided content is determined to be in violation of copyright laws or otherwise illegal, access to that information will be blocked until such time as the information is corrected by the client. Monthly fees and maintenance fees will continue to apply during this time.

Copyright issues

You are responsible for the contents of your Web Site. You agree not to furnish for publication any copyrighted material without the full consent of copyright holders. We reserve the right to suspend your account in the case of such violations.

All material created by QGM including; Original Art, Advertising Copy, Layouts, Files, or other creative works, shall remain the sole property of QGM. Materials created by QGM are for the sole purpose of fulfilling the Web Site Development agreement, and such work shall not be used for any other purpose without the express permission of QGM.

QGM grants to our clients a non-exclusive license for use of all material created by QGM for the sole purpose of display under this contract on the World Wide Web. QGM also grants a non-exclusive licence for these works for the purpose of publicizing the existence of this World Wide Web Site. QGM reserves all exclusive rights to the QGM name, logo, site hyper-links, or other references to QGM.

Unsolicited Bulk E-mail (SPAM)

The transmission of unsolicited or prohibited advertising or other content through electronic mail or inappropriate Usenet postings is forbidden. The use of QGM assigned servers for unsolicited mass mailings or postings (commonly known as "Spam") by any customer will cause that customer's services to be terminated immediately and without warning, and the customer will be held legally responsible for the damages to QGM assigned servers, both monetary and in reputation. The use of any other service to make such a mailing or posting, with any reference to QGM (including but not limited to mailboxes, autoresponders, and Web pages), shall also be grounds for account termination as described above.

The practices described here can permanently destroy an online reputation overnight, and easily taints any organization associated with the guilty party.

Illegal activities

We have the right and responsibility to fully cooperate in any legal investigation regarding any aspect of our services, including services sold to you. Please note that any use of our system to engage in software piracy or similar violations will result in account suspension and an immediate report to the FBI, SPA, and appropriate local authorities.

ECPA Notice

QGM reserves the right to monitor any and all communications through or with our facilities. QGM is not considered a "secure communications medium" for the purposes of the ECPA, and no expectation of privacy is afforded.
